The UK Government have announced that the UK intends to leave the European Union in the likely event of a No-Deal Brexit on the 31st October 2019 at 11pm. This means that freedom of movement as we know it will come to an immediate end on this date. Breytenbachs are therefore urging clients to secure their status in the UK prior to this departure date.
The Government have implemented the EU Settlement Scheme which allows EU, EEA, Swiss Nationals and their eligible family members to apply for UK immigration status in order to remain in the UK post Brexit. Under this Scheme, applicants will either be granted Settled Status, provided they have lived in the UK for 5 years or more. Or, Pre-Settled Status for those living in the UK who have not yet completed the 5 year qualifying period for Settled Status.
As a contingency, the UK Government have also introduced a Temporary Leave to Remain route for applicants arriving after the 31st October 2019 which will allow leave for 3 years. However, this will not lead thereafter to status under the EU Settlement Scheme or Indefinite Leave to Remain.

I am an EU citizen and would like to relocate to the UK, before Brexit. What date do I have to be in the UK to qualify for pre-settlement?
At this stage it seems like the UK is heading for a no-deal Brexit. We therefore strongly advise that all EU passport holders enter the UK before 31 October 2019, should they want to be included under the current EU Settlement Scheme.
What rights will I have when I receive settled status as an EU citizen?
When an EU citizen receives settled status, they will be able to live and work in the UK without restrictions. Some other rights include;
- You will be able to apply for British citizenship, if you are eligible;
- No work restrictions;
- Full access to the NHS;
- Access to public funds, such as benefits and pensions, if you are eligible;
- Your children born in the UK will automatically be British citizens.
