Our client, a national from South America, obtained a Skilled Worker Visa in 2019. In 2020, our client acquired EEA citizenship. Due to excessive absences from the UK, our client was not able to obtain Indefinite Leave to Remain under the Skilled Worker Visa category.

The EU Resolution Centre granted our client settled status under the EUSS. The caseworker exercised discretion. Instead of pre-settled status, our client was granted settled status in advance.

What is a Settled Status under the EUSS?

You can obtain Settled Status if you reside in the UK continuously for five years. This period starts from either your initial entry into the UK (before December 2020) or the date your pre-settled status was granted. To be eligible, you must not leave the UK for more than 180 days in any 12-month period during these five years. The Home Office may also consider absences of up to 12 months for important reasons, which might not break the continuity of your residence.

Settled status is equivalent to the status of Indefinite Leave to Remain.
